Article I. General Provisions
Section 1.01 Purpose and Scope
(a) Purpose: This Administrative Code ("A Code") is established to define the governance structure, administrative procedures, and legal framework of the Duchy of Ogden.
(b) Scope: This Code applies to all Vassals, Lords, Peerage Members, and Subjects of the Sovereign Duke of Ogden across Morningside, Southside, Eldon, Mt. Evergreen, the Equatorial Duchy Constituencies, and Bath-in-abeyance.
(c) Jurisdiction: The Duchy of Ogden exists within the laws of the United States of America and the Commonwealth of Virginia and abides by the adopted ordinances of the Counties and Town of Appomattox, as stipulated in the Enduring Compact of the Chesterfield Turnpike (July 1, 2020).
(d) Right of Rescindment: The Duchy retains the right of rescindment as outlined in Item 3 of the Enduring Compact if deemed in the interest of the Duchy's people.
(e) Legal Compliance: Notwithstanding any provision herein, this Code and all actions taken pursuant to it shall be interpreted and applied only to the extent permissible under and in compliance with the laws of the United States of America and the Commonwealth of Virginia. Any provision that may be construed as exceeding such authority is to be regarded as symbolic or ceremonial in nature and without legal force or effect.
Section 1.02 Official Language
(a) The official language of the Duchy of Ogden for all administrative and legal purposes shall be English.
(b) All official documents, proceedings, and communications shall be conducted in English.
Section 1.03 Non-Discrimination Policy
(a) The Duchy of Ogden is committed to equality and non-discrimination in all aspects of governance and administration.
(b) No individual shall be discriminated against on the basis of race, color, religion, sex, national origin, age, disability, or any other characteristic protected by applicable law.
Section 1.04 Definitions
For the purposes of this Code, unless the context clearly indicates otherwise:
(a) "Duchy" means the Duchy of Ogden. (b) "Duke" refers to the Sovereign Duke of Ogden. (c) "Ducal Seat" refers to Morningside (Spencer House). (d) "Enduring Compact" means the Enduring Compact of the Chesterfield Turnpike, dated July 1, 2020.
Section 1.05 Severability
If any provision of this Code or its application to any person or circumstance is held invalid, the remainder of the Code or the application of the provision to other persons or circumstances is not affected.
Section 1.06 Supremacy and Conflict Resolution
(a) This Code shall be the supreme law of the Duchy, subject to the laws of the United States and the Commonwealth of Virginia as per the Enduring Compact.
(b) In case of conflict between provisions within this Code, the more specific provision shall prevail over the general provision.
Section 1.07 Interpretation Guidelines
(a) This Code shall be interpreted according to the plain meaning of its language.
(b) Where ambiguity exists, interpretation shall be guided by the purpose and intent of the provision in question.
(c) All provisions of this Code shall be construed in a manner consistent with applicable federal and state laws.
Section 1.08 Amendment Procedures
(a) Amendments to this Code may be proposed by the Duke, the Lords of Morningside, or through petition by Subjects of the Duchy.
(b) All amendments must be approved by a majority vote of the Lords of Morningside and ratified by the Duke.
Section 1.09 Effective Dates and Transitional Provisions
(a) This Code shall come into effect on [INSERT DATE].
(b) All prior laws, decrees, and regulations not in conflict with this Code shall remain in effect until explicitly repealed or amended.
Section 1.10 General Enforcement Provisions
(a) The Duke and designated officials shall have the authority to enforce the provisions of this Code.
(b) Penalties for violations of this Code shall be determined by the nature and severity of the offense, as outlined in subsequent articles.
Section 1.11 Administrative Authorities
(a) The primary administrative authorities of the Duchy are the Duke, the Lords of Morningside, and the Spencer House Forum.
(b) The Duke may delegate administrative authority as deemed necessary for effective governance.
Section 1.12 Public Access and Transparency
(a) All non-confidential records and proceedings of the Duchy shall be accessible to the public.
(b) Official notices and publications shall be made available through designated channels, including the Duchy's official website and public notice boards.
Section 1.13 Measurement Standards
The Duchy of Ogden shall use the International System of Units (SI) for all official measurements, with customary units provided in parentheses where appropriate.
Section 1.14 General Record-Keeping Requirements
(a) All official records of the Duchy shall be maintained in a secure and accessible manner.
(b) The preferred date format for all official documents shall be ISO 8601 (YYYY-MM-DD).
Section 1.15 Interpretation for Courts
In matters relating to estates, wills, and property assignments, every effort has been made to apply the laws of the Duchy in alignment with prevailing federal and state law. Courts of the Commonwealth of Virginia and the United States are advised to interpret these sections with the understanding that they are intended to complement, not conflict with, applicable state and federal statutes.
Article II. Governance Structure
Section 2.01 The Duke

Succession to the Duchy Act 2024

An Act to make succession to the Dukedom not depend on gender.

BE IT ENACTED by the Duke's Grace, by and with the advice and consent of the Lords Spiritual and Temporal, and the Members-Forum, in this present Parliament assembled, and by the authority of the same, as follows: —
1. Succession to the Duchy not to depend on gender
(1) In determining the succession to the Duchy, the gender of a person born after 1 July 2024 does not give that person, or that person's descendants, precedence over any other person (whenever born).
(2) The firstborn child of the body of Nathan I, of Flood, and the heirs of the body of such child, shall succeed to the Duchy. In default of such issue, the succession shall pass to the next eldest child of the body of Nathan I, of Flood, and the heirs of the body of such child, and so on, without regard to gender.
(3) In the absence of any heir of the body of Nathan I, of Flood, the succession shall pass to the pre-birth heir presumptive line, being the firstborn child of the body of Donald I, of Ogden, and the heirs of the body of such child. In default of such issue, the succession shall pass to the next eldest child of the body of Donald I, of Ogden, and the heirs of the body of such child, and so on, without regard to gender.
2. Regency Provisions
(1) In the event the heir succeeds to the title while still a minor, a Regency shall be established.
(2) The Regency Council shall govern until the heir reaches the age of majority, as defined in Section 3 of this Act.
3. Age of Majority and Assumption of Duties
(1) The age of majority for the purposes of assuming full ducal responsibilities shall be 21 years.
(2) The reigning Duke or Duchess may, by declaration, reduce this age to no less than 18 years if deemed appropriate and in consultation with the Lords of Morningside.
4. Amendments to Succession
(1) Any changes to this succession law must be approved by a three-fourths majority of the Lords of Morningside and ratified by the reigning Duke or Duchess.
(2) Such changes shall not affect the rights of any person already in the line of succession at the time of the amendment.
5. Relation to Commonwealth Law
(1) This succession law shall be recognized as the internal law of the Duchy of Ogden, in accordance with the Enduring Compromise of the Chesterfield Turnpike.
(2) It shall be understood that this law applies solely to the succession of the Duchy and does not conflict with or supersede the laws of the Commonwealth of Virginia or the United States of America.
6. Commencement and short title
(1) This Act comes into force on 1 July 2024.
(2) This Act may be cited as the Succession to the Duchy Act 2024.

Section 4.01 Sum Sufficient Treasury Act
(a) Authorization of Emergency Procurement and Expenses
- In the event of an emergency, as declared by His Grace, the Duke, or his duly authorized representative, the Ministry of Finance is hereby authorized to undertake emergency procurement and to incur necessary expenses without adhering to standard procurement procedures, provided that such actions are essential for addressing the emergency situation.
(b) Expedited Approvals
- The Ministry of Finance shall establish an expedited approval process for emergency procurement and expenses, ensuring swift and effective response to emergent needs.
- Such expedited approvals shall not be subject to the standard review times and may bypass certain procedural requirements in the interest of urgency.
(c) Limited Procurement Rules
- During an emergency, procurement rules may be temporarily relaxed or modified to facilitate the rapid acquisition of goods, services, and resources necessary to address the emergency situation.
- Any relaxation or modification of procurement rules shall be documented and justified in writing by the Ministry of Finance.
(d) Sufficiency of Funds
- Emergency procurement and expenses authorized under this section may only be undertaken if there are sufficient funds in the treasury to obligate for such purchases.
- The Ministry of Finance shall ensure that all emergency expenditures are within the fiscal capacity of the Duchy's treasury, maintaining financial stability and integrity.
(e) Reporting and Accountability
- The Ministry of Finance shall provide regular reports to His Grace, the Duke, the Lords of Morningside, and other relevant oversight bodies on the implementation of emergency procurement and expenses, including details of expenditures, procurement processes used, and the outcomes achieved.
- Any actions taken under this section shall be subject to post-emergency review and audit to ensure compliance with the Duchy's financial management principles and accountability standards.

Section 4.04 Peerage Bank of Ogden
(a) Purpose and Function
The Bank is hereby charged with the following mandates:
- To act as a Fund of Efficiency during times of economic opportunity, providing necessary capital for peerage members to advance the Duchy's interests or grow its GDP.
- To serve as a Bank of Establishment for young members of the peerage, aiding them in acquiring real properties, securing guild memberships, or pursuing trade and liberal education.
- To operate as a Fund of Efficient Capital, offering financial assistance at preferential rates not to exceed twelve percent (12%) per annum, thus obviating the need for external capital at usurious rates.
(b) Eligibility
Eligible members for services provided by The Bank shall be ranked and recognized in the following order of precedence, with posterity and the preservation of the peerage's welfare as the foremost priority:
- Confirmed genetic descendants of Donald I, of the Orchard.
- Life Members of the Spencer House Forum.
- Members of the Protectorate Council of Lady Vienna, et seq. Heirs.
- The Colonel of the Orchards.
- Lady Kaylee of Wythe, in her capacity as a natural person vested with full authority.
- Confirmed non-genetic heirs who have depended on the peerage for at least twelve months prior to reaching the age of majority.
- Any other individual natural person, at the sole discretion of the Duke, sanctioned by recorded ducal warrant with hand signature and seal.
(c) Financial Assistance
- The Bank shall offer loans, including a "full bond" loan equivalent to fifty (50) ounces of gold coinage or its fiat currency equivalent, repayable over seven years at a ducal interest rate not to exceed twelve percent (12%).
- Eligibility for a "full bond" loan shall recur once every fourteen (14) years without custodianship, barring exceptional circumstances approved by the Duke.
(d) Governance
The Bank shall be governed by a Board of Directors appointed by the Duke, and it shall operate under the laws and regulations established by the Duchy of Ogden. The Board shall ensure that all activities of The Bank align with the principles and objectives set forth in these letters.
(e) Amendments and Revisions
These provisions may be amended, revised, or repealed only through a subsequent Ducal Letters Patent issued under the same authority as herein provided.
Section 4.08 Noble & Common Contribution Code (NCCC)
A. Establishment and Purpose
- The Noble & Common Contribution Code (NCCC) is hereby established as the primary system of taxation and contribution within the Duchy of Ogden.
- The NCCC ensures fair and proportionate contributions from all members of the Duchy to support its governance, infrastructure, common welfare, and spiritual enrichment.
B. Contributor Categories
- The NCCC recognizes three main categories of contributors: a. Vassals: Noble landholders and estate managers b. Peerage: Members of the nobility without significant land holdings c. Laborers: Commoners and workers within the Duchy
C. Contribution Rates
- Vassals a. Base Rate: 10% of estate income b. Additional 2% on income exceeding 10,000 gold crowns per annum
- Peerage a. Flat Rate: 8% of all income and gifts received by virtue of their station
- Laborers a. Tiered system based on income: i. Up to 1,000 silver pennies per annum: 5% ii. 1,001 to 5,000 silver pennies per annum: 7% iii. Above 5,000 silver pennies per annum: 9%
- Basilica of Our Lady of Good Counsel Construction Fund a. Additional 1% contribution from all categories towards the Basilica construction fund b. This contribution is applied after calculating the base contribution
D. Collection Method
- Contributions shall be collected at the source, similar to wage withholdings.
- For Vassals and Peerage, quarterly payments are to be made to the Ducal Treasury.
- For Laborers, employers are responsible for withholding and remitting contributions.
- The Basilica fund contribution will be collected alongside the regular contributions and earmarked separately.
E. Exemptions and Deductions
- Charitable donations to Duchy-approved causes may be deducted up to 5% of total contribution.
- Essential workers (as defined by the Ducal Council) may receive a 2% reduction in their contribution rate.
- The Basilica fund contribution is not eligible for exemptions or deductions.
F. Enforcement and Penalties
- Failure to contribute or accurately report income will result in fines of up to 150% of the unpaid amount.
- Repeated violations may result in loss of titles, land, or other privileges as determined by the Ducal Court.
G. Transparency and Accountability
- An annual report detailing the use of contributions will be made available to all contributors.
- The Spencer House Forum will have oversight on the allocation and use of these funds.
- A separate report on the progress of the Basilica construction and use of funds will be issued bi-annually.
H. Review and Amendments
- The NCCC will be reviewed annually by the Lords of Morningside.
- Amendments can be proposed by the Duke, the Lords of Morningside, or through petition from the Spencer House Forum.
I. Basilica Fund Sunset Clause
- The additional 1% Basilica fund contribution will cease once the construction is completed or after 10 years, whichever comes first.
- Any excess funds at the completion of construction will be allocated to the Basilica's maintenance and operations.
J. Enactment
- This section shall take effect on the first day of the next fiscal quarter following its proclamation.
- All previous laws and regulations inconsistent with this section are hereby repealed to the extent of such inconsistency.

Article XII. Foreign Affairs
Article Description: This section establishes the Ministry of Foreign Affairs as the primary governmental body responsible for the Duchy of Ogden's diplomatic engagements, international relations, and the administration of foreign affairs. The Ministry will oversee the formulation and execution of the Duchy's foreign policy, ensuring its alignment with the broader interests and security of the Duchy.
Section 12.01 Establishment of the Ministry of Foreign Affairs
This section establishes the Ministry of Foreign Affairs as the primary governmental body responsible for the Duchy of Ogden's diplomatic engagements, international relations, and the administration of foreign affairs.
Section 12.02 Appointment of the Foreign Minister
The Foreign Minister shall be appointed by the Prime Minister with the consent of the Duke and confirmation by the Lords of Morningside.
(a) Appointment Process
The Foreign Minister shall be appointed through a collaborative process initiated by the Prime Minister, who shall nominate a candidate for the position. This nomination is subject to the express consent of His Grace, the Duke of Ogden.
(b) Confirmation by the Lords of Morningside
Following the Duke's consent, the nomination shall be presented to the Lords of Morningside for confirmation. The Lords shall conduct a review, which may include hearings or inquiries into the qualifications and suitability of the nominee for the role of Foreign Minister.
(c) Qualifications
The nominee for the position of Foreign Minister must demonstrate:
- Substantial experience and expertise in international relations, diplomacy, or related fields.
- A clear understanding of the Duchy of Ogden's foreign policy objectives, diplomatic priorities, and international obligations.
- Unimpeachable integrity and commitment to the welfare and security of the Duchy of Ogden.
(d) Oath of Office
Upon confirmation by the Lords of Morningside, the appointed Foreign Minister shall take an oath of office, pledging to faithfully execute the duties of the position, uphold the laws and customs of the Duchy, and protect its interests and sovereignty.
(e) Term and Tenure
The Foreign Minister shall serve at the pleasure of His Grace, the Duke, and the Prime Minister, with the term of office being subject to the operational needs and strategic objectives of the Duchy's foreign affairs. The Foreign Minister may be reappointed or replaced at the discretion of the appointing authorities, in consultation with the Lords of Morningside.
(f) Duties and Responsibilities
The Foreign Minister is charged with the overall leadership and management of the Ministry of Foreign Affairs, the formulation and execution of the Duchy's foreign policy, the maintenance of diplomatic relations, and the representation of the Duchy in international forums and negotiations.
(g) Accountability
The Foreign Minister shall be accountable to His Grace, the Duke, the Prime Minister, and the Lords of Morningside for the effective and ethical conduct of the Ministry of Foreign Affairs and the achievement of the Duchy's foreign policy goals.
(h) Removal from Office
The Foreign Minister may be removed from office for cause, including but not limited to, malfeasance, nonfeasance, or actions detrimental to the interests and security of the Duchy. Such removal shall be effected by His Grace, the Duke, upon the recommendation of the Prime Minister and after consultation with the Lords of Morningside.
Section 12.03 Diplomatic Relations
The Ministry of Foreign Affairs is charged with establishing and maintaining diplomatic relations with other sovereign states, international organizations, and entities.
Section 12.04 Passport Issuance and Management
The Ministry shall oversee the issuance of passports to Ducal subjects, ensuring the integrity and security of travel documents.
(a) Passport as Bond
- Every passport issued by the Duchy of Ogden shall also function as a bond, herein referred to as the "Passport Bond."
- The Passport Bond shall be secured by the full faith and credit of the Duke of Ogden.
(b) Monetary Value
- The monetary value of the Passport Bond is set at $100,000 US Dollars, or its equivalent in Euros or Swiss Francs.
- The conversion rates applicable shall be those in effect at the time of the bond's invocation, as determined by the Ministry of Foreign Affairs.
(c) Conditions for Holding in Trust
- The Passport Bond may be held in trust by a duly recognized financial institution or legal entity, as approved by the Ministry of Foreign Affairs.
- The terms and conditions governing the trust shall be established in accordance with the laws of the Duchy and international trust and banking standards.
(d) Invocation of the Bond
- The Passport Bond may be invoked under circumstances of grave distress, including but not limited to, situations necessitating the repatriation of a Ducal subject.
- Other matters warranting the invocation of the bond must be expressly authorized by the Ministry of Foreign Affairs, under the guidance of the Foreign Minister.
(e) Authorization and Regulation
- The issuance, management, and invocation of the Passport Bond shall be regulated by the Ministry of Foreign Affairs, under the authority granted by the "Sum Sufficient Treasury Act of 2020."
- Detailed regulations and procedures pertaining to the Passport Bond shall be published by the Ministry of Foreign Affairs and made available to all Ducal subjects.
(f) Liability and Redemption
- The liability of the Duchy under the Passport Bond is limited to the conditions specified in this section.
- Redemption of the bond for cash or its equivalent shall be subject to the approval of the Ministry of Foreign Affairs and in accordance with the procedures established by the Duchy's financial regulations.
(g) Amendments and Revisions
- The provisions governing the Passport Bond may be amended or revised by the Ministry of Foreign Affairs, subject to the approval of His Grace, the Duke, and in consultation with the Lords of Morningside.
- Any amendments or revisions shall be promptly communicated to all Ducal subjects and relevant entities.
Section 12.05 Support for Ducal Subjects Abroad
The Ministry is responsible for providing support and protection to Ducal subjects traveling or residing abroad. This includes consular services, emergency assistance, and advocacy in legal matters, ensuring the welfare of Ducal subjects in foreign jurisdictions.
Section 12.06 Mutual Aid for Allied Nations
In times of crisis, the Duchy of Ogden commits to providing mutual aid to allied nations, as stipulated by international agreements or special arrangements. This provision underscores the Duchy's commitment to international solidarity and cooperation.
Section 12.07 Visa Issuance
The Ministry shall establish comprehensive visa policies governing the entry of foreign nationals into the Duchy. This includes various visa categories, application processes, and eligibility criteria, ensuring the Duchy's security and compliance with international standards.
Section 12.08 Special Provisions
Special provisions may be applied to certain groups or individuals, including diplomatic immunity for foreign diplomats, expedited processes for allied nationals, and specific arrangements for distinguished guests, reflecting the Duchy's flexible and adaptive approach to international relations.
Section 12.09 Prohibition on Imports
In accordance with international law and the Duchy's regulations, the Ministry shall enforce prohibitions on the import of certain goods, including but not limited to, arms, controlled substances, and illicit materials, safeguarding the Duchy's security and public health.
Section 12.10 Asylum Seekers
The Ministry will establish a fair and humane process for asylum seekers, outlining the rights, obligations, and procedures for individuals seeking refuge within the Duchy due to persecution or conflict in their home countries, affirming the Duchy's commitment to international humanitarian principles.
Article XIV: The Orchardiers of Ogden
A. Establishment and Purpose
- The Orchardiers of Ogden are hereby established as the primary military and security force of the Duchy of Ogden.
- The Orchardiers shall be responsible for the defense, security, and stability of the Duchy, both internally and externally.
B. Command Structure
- The Orchardiers shall be under the command of the Colonel of the Orchards, who reports directly to the Duke of Ogden.
- The Colonel of the Orchards shall be appointed by the Duke, with the advice and consent of the Lords of Morningside.
C. Corps Structure
The Orchardiers shall consist of seven distinct corps, each with specific roles and areas of responsibility:
1. 1st Orchardiers - "Old Corps"
- Role : Ceremonial guard of the Duchy, performing duties at state functions and representing historical valor.
- Area of Responsibility (AOR) : Ducal Palace and key historical sites within the Duchy.
2. 2nd Orchardiers - "The Duke's Guard"
- Role : Direct protection of the Duke and the Ducal family, serving as personal bodyguards.
- AOR : Morningside, the ducal seat, and accompanying the Duke during travel.
3. 3rd Orchardiers - "Counter Terrorism and Special Operations"
- Role : Specialized in rapid response, counter-terrorism tactics, and high-risk operations.
- AOR : Duchy-wide, focusing on strategic and vulnerable locations.
4. 4th Orchardiers - "Technical and Psychological Operations"
- Role : Handling cyber warfare, information operations, and psychological operations.
- AOR : Not limited by geographical boundaries, focusing on digital and psychological battlefields.
5. 5th Orchardiers - "Logistics and Support"
- Role : Managing logistics, supplies, transportation, and crucial support services.
- AOR : Centralized logistics hub with services extending across all areas of Orchardier operations.
6. Ogden Expeditionary Force (the Sixers)
- Role : Rapid deployment force for operations within and beyond the Duchy's borders.
- AOR : External missions and internal reinforcement as needed.
7. 7th Orchardiers - "The Regular Army of Ogden"
- Role : Fully operational regular army unit for enhanced defensive capabilities and rapid response.
